By registering for the Online Mayor’s Working Permit (Site), you accept and agree to be legally bound by these Terms and the terms stated below. If you do not understand or do not wish to be bound by these Terms, you cannot access or use any of the services provided in this Site.

Additionally, you accept that you have read and agree to abide by the terms and conditions of this Site. Except for those terms and conditions that will survive and remain effective after termination as stated in these Terms, pursuant to law or regulation, or whose operation necessarily requires survival after the termination, these Terms shall be effective, valid, and binding from the time of your agreement, which is from the time of your download, activation, or use of this Site, and will continue to exist until it is terminated by you or by us.

These Terms may be changed at any moment by The City Government of Bacoor. If there is a significant change to these terms, The City Government of Bacoor will notify you sixty (60) days in advance, or for as long as applicable laws demand, before the change takes effect. Any substantial change or modification pertaining to your use of this Site that may be mandated by our regulators or relevant laws is deemed "material." You signify your acceptance of the modified Terms if you continue accessing or using this Site after you have been notified of such changes.

Any other language version of these terms is offered for convenience, and you acknowledge and agree that in the event of a translation or meaning conflict, the English version will take precedence.

Conditions of Use

By using this website, you certify that you have read and reviewed this Agreement and agree to be bound by its terms. If you do not want to be bound by the terms of this Agreement, you are advised to stop using the website accordingly. The use and access to this website are only granted to those who accept its terms. These terms and conditions may be amended by us at any time without prior notice.

As a user of this website, you may be asked to register and provide accurate and complete information during the registration process to complete your application for the Mayor’s Working Permit. By clicking the “Save” button on the application page, you hereby agree to accept all associated conditions, consequences, and effects of your submission.

Account Security

You are solely responsible for maintaining the confidentiality and security of your account credentials. You are also responsible for preventing unauthorized access to the Site using your registration information and for all activities that occur under your account or password. If you suspect any security issues with your account, please notify us immediately so we can address them accordingly.

License and Site Access

We grant you a limited license to access and make personal, internal, and non-commercial use of this website. You are not allowed to download or modify the website without our written permission.

Non-transferable

Your right to use the Site is not transferable or assignable. Any password or access rights given to you for proceeding with the Working Permit application process or for obtaining information or documents are strictly non-transferable or non-assignable.

Forms & Documents

Downloadable forms, checklists, and legal documents will be made available through the Site that can be used in your transactions with the City Government of Bacoor for the Application of the Mayor’s Working Permit. All documents are provided on a non-exclusive license for personal, one-time, non-commercial use only, without any right to distribute, assign, or transfer such license.

Use of Information

We reserve the right, and you authorize us, to use and process all information regarding your access to the Site and all information provided by you in a manner consistent with the Data Privacy Act and relevant regulations. You agree that all the personal information you provided us will be used to process your application for the Mayor’s Working Permit.

Payment Transaction

By using this Site, you agree to pay the relevant fees required for the application of a Mayor’s Working Permit. You will be notified of the applicable fees and charges prior to completing a transaction

This Site allows you to pay for services online; thus, you authorize the City Government of Bacoor and the Payment Gateway to process, share, and store your transaction details, including the sharing to any third-party service providers, as necessary to complete your payment.

You hereby acknowledge and agree that the City Government of Bacoor will only issue an Official Receipt in printed form that you must pick up in the City Hall. The said Official Receipt will only cover the payment for the Mayor’s Work and Sanitary Permit and shall not cover the payment for the Diagnostic Center and the processing fee of the Payment Gateway. The Diagnostic Center shall issue a separate Official Receipt for the diagnostic fees. The Payment Gateway, on the other hand, shall issue an acknowledgment receipt that will be sent via the email you used during registration.

Intellectual Property

You acknowledge that all materials and services provided on this website are the property of the City Government of Bacoor. You agree not to reproduce, distribute, or otherwise use the City Government of Bacoor's intellectual property, including electronic, digital, or new trademark registrations.

User Content

You consent to:

• Not conceal your true identity or use a fictitious name in order to commit a crime, evade the application of a judgment, or cause harm;
• Allow the City Government of Bacoor to store your password in an encrypted format on the device and our servers, if applicable. When you log into this Site, this encryption technique allows us to confirm your identity while hiding your password on the server.
• Accept full responsibility for any claims made by you or any third party regarding any user content you produce, post, send, or view while utilizing this Site, and hold City Government of Bacoor harmless from such claims. You acknowledge liability to the City Government of Bacoor for any losses or damages the City Government of Bacoor may suffer as a result of your use or misuse of this Site. You also accept responsibility for the results of your actions and interactions while using this Site;
• Unless you have the required licenses, rights, consents, and permissions to use and authorize the City Government of Bacoor to use any and all User Content you create, upload, transmit, or display via this Site, you must not share, create, upload, transmit, or display any material, information, or User Content that is or could be protected by copyright, patent, trade secret, trademark, trade name, service mark, or any other property rights, including privacy and/or publicity rights;
• It is forbidden to distribute, produce, upload, transmit, or display any information, material, or User Content via this Site that: infringes upon the rights of any third party to intellectual property, privacy, or publicity; is intentionally false and/or defamatory, inaccurate, abusive, vulgar, hateful, harassing, obscene, indecent, pornographic, profane, threatening, racist, gruesome, offensive to public morality, invasive of others' privacy, or otherwise in violation of any laws, rules, or regulations; contains Trojan horses, worms, bots, ransomware, or any malicious malware, applications, or programs, code, or routines that may or are intended to damage, interfere with, or steal any City Government of Bacoor system, data, or personal information; encourages or facilitates piracy; or could result in cybersecurity attacks and breaches; not to start or distribute chain letters; and not to use this Site to conduct or support surveys, competitions, petitions, or other similar activities unless those services were created and especially intended for such uses. You understand and consent that the City Government of Bacoor will take the appropriate steps to protect your City Government of Bacoor Account and this site from any cybersecurity threats and security breaches if any of the aforementioned are found;

Prohibitions on Use

Your license for access and use of the Site and any information, materials, or documents (collectively defined as “Contents”) therein are subject to the following prohibitions:

• Copy, print (except for the express permission for purposes of securing Mayor’s Working Permit), republish, display, distribute, transmit, sell, or otherwise make available in any form or by any means all or any portion of the Site or any Contents retrieved from it;
• Use the Site, or any of its Contents, to develop, as a component of, any information, storage and retrieval system, database, information base, or similar resource (in any media now existing or hereafter developed) that is offered for commercial distribution of any kind;
• Make any portion of the Site available through any time-sharing system, service bureau, the Internet, or any other technology now existing or developed in the future;
• Remove, decompile, disassemble, or reverse engineer any Site software or use any network monitoring or discovery software to determine the Site architecture;
• Use any automatic or manual process to harvest information from the Site;
• Use the Site in a manner that violates any applicable national law or local ordinance regulating transmission of information.

Unlawful Activity

We reserve the right to investigate complaints or reported violations of this Agreement and to take any action we deem appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, email addresses, usage history, posted materials, IP addresses, and traffic information.

Applicable Law and Venue of Litigation

By using this website, you agree that applicable laws of the Philippines will govern these terms and conditions and any dispute of any sort that might come between you and us.

Any dispute related to the use of this website shall be resolved through arbitration in the courts within the City of Bacoor, Cavite, and you consent to the exclusive jurisdiction and venue of such courts.

Indemnification

You agree to hold the City Government of Bacoor harmless against legal claims and demands that may arise from your use or misuse of this Site.

4. RESERVED RIGHTS

At our discretion and without any commitment, we maintain the sole right to:

• Deny, reject, or disapprove any application, registration, or verification; and to limit, temporarily or permanently, any individual's access to, or discontinue, this Site, in whole or in part.
• Gather, screen, examine, flag, filter, change, block, reject, or delete any and all information that users submit to and through this Site, whether directly or indirectly. This information may include, but is not limited to, IP addresses, hardware specifications, browser type information, cookies, and other similar data. You hereby give the City Government of Bacoor Group your unchangeable consent, affirmation, and promise to protect it from all claims resulting from the gathering, vetting, reviewing, flagging, filtering, altering, blocking, rejecting, or deleting of any and all information submitted by any User via this Site.
• Improve the Site. Hence, you acknowledge, agree, and affirm that any enhancements, developments, new features, and/or new functionalities added to this Site will be considered part of this Site; this Site as defined herein will be subject to these Terms and any future revisions or amendments, as applicable.
• Place restrictions on the use of this Site and collect fees and associated taxes whenever necessary and with advance notice.

Additionally, you understand and consent to the City Government of Bacoor's right, at its sole discretion and without any obligation, to change the applicable fees, taxes, and charges related to using this Site at any time, providing you with at least thirty (30) days written notice before the changes take effect.

Limitation on Liability

The service offered by this Site is offered on an “as is” basis without any warranties of any kind except those required by applicable laws.

The City of Bacoor shall not be liable for any claims arising from, in connection with, or as a result of any acts or circumstances that are beyond its control, including:

• The misuse or abuse of this Site by the User
• The refusal of the third-party service provider to accept payment
• Any unauthorized transaction
• The User is unable to perform or complete any transaction due to service unavailability of the internet or ISM provider.
• Any misrepresentation, fraud, or misconduct by any third party.
• Failure of the User or applicant to obtain the printed and signed copy of the Mayor’s Working Permit.

Lastly, the City of Bacoor shall not be liable if the Mayor's Permit is not processed due to your own fault, negligence, or medical condition. In such cases, no refund will be given.

Non-Waiver of Rights

Failure or delay on the part of the City of Bacoor or the User to exercise its rights or remedies under these Terms and applicable laws shall not operate as a waiver of the same.

Termination

You agree that any termination of your access to the Site may be effected without prior notice for lack of use or if the City Government of Bacoor, in its sole opinion, believes that you have violated or acted inconsistently with this Agreement or that you are a repeat infringer of intellectual property rights.

Separability Clause

Should any of the Terms of this Agreement be rendered void, illegal, or unenforceable in any respect under any law, the validity, legality, and enforceability of the remaining Terms shall not be affected nor impaired thereby.
